By activating a MAINTAIN subscription, you agree to the terms outlined below.

1. WHO IT’S FOR

The MAINTAIN Package is designed for founders and teams who’ve already launched and now need ongoing expert support to keep everything running smoothly. This subscription is ideal for those who want peace of mind without worrying about downtime, minor bugs, or outdated content. You focus on growth — we maintain the foundation.We’re not reinventing. We’re refining, fixing, and fine-tuning.

2. WHAT’S INCLUDED

The Service Provider agrees to provide ongoing maintenance and support services for the Client’s website, Content Management System (CMS), Customer Relationship Management (CRM), and online booking system. The specific services covered under this Agreement include:

  • Website Maintenance: Regular updates to website content, functionality checks, bug fixes, and performance optimization.
  • CMS Maintenance: Ensuring the CMS is updated, secure, and optimised, including plugin updates, software updates, and user support.
  • CRM Maintenance: Data management, system optimization, user support, and troubleshooting.
  • Online Booking System Maintenance: System monitoring, bug fixing, functionality enhancements, and integration support with other systems as necessary.

3. HOW IT WORKS

The Service Provider agrees to perform the following maintenance services:

  • Updates and Upgrades: Regular updates of the software, CMS, CRM, and booking system to ensure compatibility, functionality, and security.
  • Bug Fixes and Troubleshooting: Identification and resolution of system issues within 48 hours.
  • Backups: Regular backups of the website, CMS, CRM, and booking system, with a restoration protocol in case of data loss.
  • Security: Regular security checks and updates to prevent unauthorised access or data breaches.
  • Performance Optimization: Regular assessments and adjustments to ensure optimal system performance.
  • User Support: Support for Client’s staff with issues or questions regarding the CMS, CRM, and booking system.
  • Premium Plugins Licensing: Updates of any premium plugins utilised on your website during an active subscription (GROW, BUILD or UNLIMITED) 

4. Service Hours and Availability

  • Service Hours: Maintenance services will be provided during business hours: 9:00 AM to 6:00 PM, Monday to Friday. 
  • Response Time: The Service Provider agrees to respond to issues within 24 hours during business hours.

5. SUBSCRIPTION, BILLING & PAYMENT

  • The MAINTAIN SUBSCRIPTION is billed monthly via Stripe, with auto-renewal.
  • Clients manage their subscription (pause, cancel, resume) via the Client Portal.
  • Additional Costs: Any additional features, upgrades, or service requests outside the scope of this Agreement will incur additional charges, which will be discussed and agreed upon with the Client in advance.

6. TERMINATION & PAUSING

  • You may pause or cancel your subscription at any time via the Client Portal, effective at the next billing cycle.
  • There is no minimum commitment.
  • Service may be suspended for non-payment or repeated violations of this Agreement.

7. LIABILITY

  • Limitation of Liability: The Service Provider shall not be liable for any damages, losses, or liabilities arising from the use or performance of the Client’s website, CMS, CRM, or online booking system, except in cases of gross negligence or willful misconduct.
  • Warranty: The Service Provider does not warrant that the system will be error-free or uninterrupted, but will take all reasonable steps to ensure quality performance.

8. MODIFICATION OF TERMS & PRICING

  • 1045AM may update these Terms without prior notice
  • Pricing changes will be communicated 30 days in advance
