By activating a subscription, you agree to the terms outlined below.

1.WHO IS IT FOR

The BUILD package is designed for entrepreneurs, founders, and teams who already have a clear direction and need a capable digital team that can execute quickly and professionally.

Through BUILD, the Client does not purchase business or marketing strategy, but rather the capacity of a multidisciplinary team that implements digital solutions.

BUILD is suitable for:

• development and launch of digital products
• implementation of technical infrastructure
• web design and development
• integration of a business’s digital systems

SUBSCRIPTION STRUCTURE

The BUILD subscription is available in three capacity levels, which determine the number of tasks that can be processed simultaneously.

START BUILD

• 1 active task at a time
• delivery: 1 task approximately every 24–48 working hours

BOOST BUILD

• 2 active tasks simultaneously
• delivery: up to 2 tasks approximately every 24–48 working hours

EXPAND BUILD

• 3 active tasks simultaneously
• delivery: up to 3 tasks approximately every 24–48 working hours

The selected level determines the team capacity reserved for the Client, not the type of services available.The Client may have unlimited tasks in the backlog, which are processed according to the priorities set by the Client and the capacity of the selected subscription.

Note: The BUILD digital services subscription focuses on execution and technological implementation. It does not include growth strategy development, brand audits, or marketing planning.

4. HOW IT WORKS

• You may add unlimited tasks to the backlog through the Client Portal.
• Tasks can be submitted:
• a) by the client, through the form available in the portal
  b) by the agency, following planning sessions or project discussions
• Tasks are processed according to the priority established by the Client.
• An initial solution is typically delivered within 1–3 working days.
• If no feedback is provided within 3 working days, the task is considered approved.
• If feedback requires significant changes, a new task will be created.
• Strategy sessions, alignment sessions, or workshops are considered active tasks.
• Working hours: Monday–Friday, 09:00–17:00
  Client support: Monday–Sunday, 08:00–20:00

4. FEEDBACK SESSIONS

• Unlimited feedback sessions are included for each task.
• Major changes in direction or scope may be treated as a new task. 

5. CLIENT RESPONSIBILITIES

For the smooth running of the project, the Client agrees to:

• Provide clear instructions, brand materials, and necessary copy
• Provide prompt feedback and access credentials (hosting, CMS, etc.)
• Use the Client Portal to manage and prioritise tasks 

6. PAYMENT AND BILLING

• The BUILD package is billed monthly via Stripe, with automatic renewal.
• The Client may pause, cancel, or resume the subscription at any time directly from the Client Portal.
• Due to the customised nature of the service, refunds are not provided for partially used periods.

7. DELIVERABLES & OWNERSHIP RIGHTS

After payment is completed:

• Final deliverables become the property of the Client
• Exported files and final assets are provided to the Client
• Premium assets used in the project (images, fonts, modules) are included in the subscription

1045AM reserves the right to present the work in its portfolio unless a contractual restriction exists.

8. ADD-ONS, BOOST & RUSH DELIVERIES

Services that exceed the standard BUILD scope may be offered as paid add-ons.

Urgent requests requiring delivery under 24 hours or outside working hours may involve additional fees, confirmed in writing before execution.

9. TECHNOLOGIES

We use a broad suite of tools, including but not limited to:

Client Portal, Figma, Adobe CC, WordPress, WooCommerce, Elementor, BrowserStack, Google Lighthouse, Canva, Clipchamp, After Effects, Google Analytics, Metricool, Socialbakers, BuzzSumo, Feedly, Planable, ContentCal.

10. TERMINATION AND/OR SUSPENSION

The Client may suspend or cancel the subscription at any time from the Client Portal.

There is no minimum contractual commitment.

The Service Provider may suspend the service in the event of:

• non-payment of invoices
• abusive use of the service
• repeated violation of this Agreement

11. LEGAL LIABILITY

1045AM is not responsible for interruptions or issues generated by third-party services, including but not limited to hosting providers, external platforms, or software vendors.

The Client is responsible for reviewing deliverables before public launch.

12. MODIFICATION OF TERMS & PRICING

1045AM may update this document.

Pricing changes will be communicated at least 30 days in advance.

13. GOVERNING LAW

This Agreement is governed by the laws of Romania. Any dispute will be settled by the competent courts of Romania.
